In the Autumn 2024 Budget, it was announced that recruitment agencies and end-clients will be responsible for the PAYE deductions made by umbrella companies that pay their temporary workers. This will take effect from April 2026 onwards.

Additionally, recruitment agencies must support end clients in determining workers' employment status while providing expertise and streamlined processes for accurate assessments. Although the ultimate responsibility for IR35 determinations now lies with end clients, agencies play a critical role in facilitating compliance through tools and systems that simplify and expedite the process. Recruitment agencies also retain the legal obligation to submit quarterly Intermediary Reports to HMRC that detail payments to workers.
